Terms of Use
These terms govern your use of claimvu.com and our copyright management and royalty collection services.
Purpose and mandate services
Claimvu Ltd (the “Company”) provides a technological platform for content creators to manage and collect their royalties internationally. By accepting these terms, you grant Claimvu a management mandate to:
- Identify your works and their exploitations on digital platforms.
- File declarations of your repertoires with partner Collecting Societies (CMOs) such as SACD, SCAM, GEMA, SIAE, SOGEM, etc.
- Collect and transfer the royalties received to you, net of our commission.
Eligibility and legal capacity
Age requirement
Services are strictly reserved for individuals aged 18 and over. Use between the ages of 16 and 18 is only permitted subject to written parental authorization and co-signature of the mandate by a legal representative.
Mandate duration
The contract is concluded for a fixed term of 36 months.
Renewal
Unless terminated by either party one (1) month before its expiry, the contract is tacitly renewed for successive periods of twelve (12) months.
Compliance with Google & YouTube policies
Claimvu is a verified application using Google API Services. Accordingly:
Data access
You expressly authorize access to your YouTube data via the
yt-analytics.readonly and youtube.readonly scopes.
Adherence to Google policies
Claimvu strictly complies with the Google API Services User Data Policy and the YouTube Terms of Service.
Control
You retain the right to revoke data access at any time via your Google Security Settings.
Compliance with Meta policies (Facebook & Instagram)
Claimvu is a registered application with Meta for Developers. Accordingly:
Data collection
Access to Meta APIs is strictly limited to identifying content eligible for royalties on Instagram and Facebook.
Adherence to Meta policies
Claimvu strictly complies with the Meta Developer Terms and Meta’s Data Protection Policies.
Protection
No personal data irrelevant to the calculation of royalties is stored permanently. We apply the security standards required by Meta for the protection of user data.
Automated processing & “Scan-Runner”
Claimvu utilizes a detection algorithm named “Scan-Runner”. If you have opted for the “Unique Author” mode, Claimvu automatically generates declaration files with CMOs based on your API statistics.
Electronic signature and evidence (eIDAS)
Claimvu uses Documenso as our electronic signature provider for mandates.
- Legal validity
- You agree that the electronic signature via Documenso has the same legal value as a handwritten signature.
- Retention
- Signature certificates, timestamps, and copies of the mandate are retained for 10 years to meet legal evidence and accounting (FEC) requirements.
Right of withdrawal (EU consumers)
If you are acting as a consumer residing in the European Union, you have 14 days to withdraw without giving any reason.
Liability and limitations
- Duty of care
- Claimvu is committed to making every effort to collect your rights but cannot guarantee the actual payment of royalties by CMOs or the constant availability of third-party APIs (Google/Meta).
- Accuracy
- You are solely responsible for the accuracy of the information provided (bank details, identity, authorship). Any false declaration may lead to immediate account suspension.
Remuneration (commissions)
Claimvu’s commissions are deducted from the royalties collected. The rates and financial terms are detailed exclusively in our General Terms of Sale (GTS/CGV).
Disputes and jurisdiction
- Governing law
- English and Welsh law.
- Mediation
- Users residing in France may refer to a competent consumer mediator.
- Jurisdiction
- For EU consumers, the courts of their domicile remain competent, and mandatory local consumer protection laws apply.
